{"id":3249,"date":"2010-11-18T15:29:44","date_gmt":"2010-11-18T20:29:44","guid":{"rendered":"http:\/\/blogs.northcountrypublicradio.org\/inbox\/?p=3249"},"modified":"2010-11-18T16:41:54","modified_gmt":"2010-11-18T21:41:54","slug":"breaking-adirondack-magazine-sued-over-paddling-stories","status":"publish","type":"post","link":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/2010\/11\/18\/breaking-adirondack-magazine-sued-over-paddling-stories\/","title":{"rendered":"Breaking:  Adirondack magazine editor sued over paddling stories"},"content":{"rendered":"<p>I was at the Adirondack Park Agency meeting today and ran into <a href=\"http:\/\/www.adirondackexplorer.org\/stories\/paddlersrightspt2.php\">Adirondack Explorer<\/a> publisher Tom Woodman.<\/p>\n<p>He handed me a press release announcing that the editor of his non-profit magazine has been sued by two landowner groups.<\/p>\n<p>The litigation following a series of stories &#8212; written by managing editor Phil Brown &#8212; on the subject of paddling access rights.<\/p>\n<p>The Friends of Thayer Lake and the Brandreth Park Association are claiming that Brown trespassed while in pursuit of the story, crossing waterways and a small portage trail which they view as private property.<\/p>\n<p>(Note:\u00a0 I also traveled the same route to report <a href=\"http:\/\/www.northcountrypublicradio.org\/news\/story\/16457\/paddlers-landowners-divided-over-river-access\">a similar story for broadcast on NCPR and NPR.<\/a>)<\/p>\n<p>Writing today in the <a href=\"http:\/\/www.adirondackalmanack.com\/\">Adirondack Almanack blog<\/a>, Brown defends his decision to paddle the route in pursuit of the story:<\/p>\n<blockquote><p>I believe the common-law right of navigation allows the public to paddle  the three waterways even though they flow through private land.<\/p>\n<p>The  state Department of Environmental Conservation\u2014as well as several legal  experts I consulted\u2014support my position.<\/p>\n<p>In September, DEC wrote to the  association\u2019s attorney, Dennis Phillips, and asserted that the waterways  are open under the common law.<\/p>\n<p>The department also asked the  association to remove cables and no-trespassing signs meant to keep the  public out.<\/p><\/blockquote>\n<p>I&#8217;ve reached out to Judson Potter, with the Brandreth Park Association, and will update this post with their comments as soon as possible.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I was at the Adirondack Park Agency meeting today and ran into Adirondack Explorer publisher [&hellip;]<\/p>\n","protected":false},"author":12,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":[],"categories":[1],"tags":[22,4792,19,48],"_links":{"self":[{"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/posts\/3249"}],"collection":[{"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/users\/12"}],"replies":[{"embeddable":true,"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/comments?post=3249"}],"version-history":[{"count":1,"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/posts\/3249\/revisions"}],"predecessor-version":[{"id":3251,"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/posts\/3249\/revisions\/3251"}],"wp:attachment":[{"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/media?parent=3249"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/categories?post=3249"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/wp-json\/wp\/v2\/tags?post=3249"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
