{"id":6990,"date":"2012-12-11T12:38:55","date_gmt":"2012-12-11T17:38:55","guid":{"rendered":"http:\/\/blogs.northcountrypublicradio.org\/inbox\/?p=6990"},"modified":"2012-12-11T12:38:55","modified_gmt":"2012-12-11T17:38:55","slug":"ny-leads-coalition-in-climate-change-suit","status":"publish","type":"post","link":"https:\/\/blogs.northcountrypublicradio.org\/inbox\/2012\/12\/11\/ny-leads-coalition-in-climate-change-suit\/","title":{"rendered":"NY leads coalition in climate change suit"},"content":{"rendered":"<p>New York\u2019s latest activist-attorney general has put the EPA on notice about greenhouse gas emissions \u2013 more specifically, methane.<\/p>\n<p>Eric Schneiderman\u2019s office sent a release this morning describing a multi-state coalition\u00a0 \u201cto curb climate change pollution from (the) oil and gas industry.\u201d<\/p>\n<p>Schneiderman calls methane, \u201ca very potent greenhouse gas.\u201d Pound for pound, the release states, \u201cit warms the climate about 25 times more than carbon dioxide.\u201d<\/p>\n<p>The seven states, New York, Vermont, Massachusetts, Rhode island, Connecticut, Maryland and Delaware, sent a notice of intent to sue today, charging:<\/p>\n<blockquote><p>EPA has missed the applicable deadline for determining whether standards and guidelines limiting methane emissions from oil and gas operations under section 111 of the Clean Air Act are appropriate and for issuing such standards, EPA\u2019s ongoing failure to address the sector\u2019s methane emissions violates the Clean Air Act and harms the health and welfare of our residents.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>In the press release, Schneiderman writes that the EPA\u2019s \u201cfailure\u201d leaves 95% of this pollution unregulated and uncontrolled.<\/p>\n<p>\u201cToday,\u201d he writes, \u201cour coalition is putting EPA on notice that we are prepared to sue to force action on curbing climate change pollution from the oil and gas industry.\u201d<\/p>\n<p>The detailed, seven-page<a href=\"http:\/\/www.ag.ny.gov\/pdfs\/ltr_NSPS_Methane_Notice.pdf\"> notice of intent<\/a> traces the background of greenhouse emissions\u2019 contributions to climate change, touching on the melting glaciers and ice caps, severe droughts, \u00a0and a \u201cstring\u201d of extreme storms in the Northeast. It notes the EPA issued its first standards for the oil and gas industry in 1985, and finalized \u00a0the required review of those rules just this year \u00a0\u2013 leaving out methane.<\/p>\n<p>&nbsp;<\/p>\n<p>It says, \u201cEPA has long known the significance of the oil and gas sector\u2019s contribution to methane emissions and the availability and cost-effectiveness of measures for reducing those emissions.\u201d<\/p>\n<p>And concludes:<\/p>\n<blockquote><p>We are willing to explore any effective means of resolving this matter without the need for litigation. However, if we do not hear from you within the applicable time periods provided in section 304 of the Act, we intend to file suit in United States District Court.<\/p><\/blockquote>\n<p>The attorneys general&#8217;s suit comes as New York&#8217;s environmental conservation department struggles to finalize its own rules for regulating hydrofracking in New York State.
